Wir informieren insbesondere, wof\u00fcr, wie und wo wir welche Personendaten bearbeiten. Wir informieren ausserdem \u00fcber die Rechte von Personen, deren Daten wir bearbeiten.  <\/p>\n<p>F\u00fcr einzelne oder zus\u00e4tzliche Aktivit\u00e4ten und T\u00e4tigkeiten k\u00f6nnen weitere Datenschutzerkl\u00e4rungen sowie sonstige rechtliche Dokumente wie Allgemeine Gesch\u00e4ftsbedingungen (AGB), Nutzungsbedingungen oder Teilnahmebedingungen gelten.<\/p>\n<p>Wir unterliegen dem schweizerischen Datenschutzrecht sowie allenfalls anwendbarem ausl\u00e4ndischem Datenschutz\u00adrecht wie insbesondere jenem der <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/DE\/TXT\/?uri=CELEX%3A32000D0518\" target=\"_blank\" rel=\"noopener\">Europ\u00e4ischen Union (EU)<\/a> mit der europ\u00e4ischen Datenschutz-Grund\u00adverordnung (DSGVO).<br \/>Die Europ\u00e4ische Kommission anerkannte mit Entscheidung vom 26. Juli 2000, dass das schweizerische Datenschutzrecht einen angemessenen Datenschutz gew\u00e4hrleistet. Mit Bericht vom 15. Januar 2024 best\u00e4tigte die Europ\u00e4ische Kommission diesen Angemessenheits\u00adbeschluss. <\/p>\n<h2 id=\"kontaktadressen\">1. Begriffe und Rechtsgrundlage<\/h2>\n<h3 id=\"begriffe\">2.1 Begriffe<\/h3>\n<p>Personendaten sind alle Angaben, die sich auf eine bestimmte oder bestimmbare nat\u00fcrliche Person beziehen. <\/p>\n<p>Besonders sch\u00fctzenswerte Personendaten sind Daten \u00fcber gewerkschaftliche, politische, religi\u00f6se oder weltanschauliche Ansichten und T\u00e4tigkeiten, Daten \u00fcber die Gesundheit, die Intimsph\u00e4re oder die Zugeh\u00f6rigkeit zu einer Ethnie oder Rasse, genetische Daten, biometrische Daten, die eine nat\u00fcrliche Person eindeutig identifizieren, Daten \u00fcber straf- und verwaltungsrechtliche Sanktionen oder Verfolgungen, und Daten \u00fcber Massnahmen der sozialen Hilfe.<\/p>\n<p>Bearbeiten umfasst jeden Umgang mit Personendaten, unabh\u00e4ngig von den angewandten Mitteln und Verfahren, beispielsweise das Abfragen, Abgleichen, Anpassen, Archivieren, Aufbewahren, Auslesen, Bekanntgeben, Beschaffen, Erfassen, Erheben, L\u00f6schen, Offenlegen, Ordnen, Organisieren, Speichern, Ver\u00e4ndern, Verbreiten, Verkn\u00fcpfen, Vernichten und Verwenden von Personendaten.<\/p>\n<p>Eine betroffene Person ist eine nat\u00fcrliche Person, \u00fcber die wir Personendaten bearbeiten.<\/p>\n<p>De<a href=\"https:\/\/de.wikipedia.org\/wiki\/Mitgliedstaaten_der_Europ%C3%A4ischen_Union\" target=\"_blank\" rel=\"noopener\">r Europ\u00e4ische Wirtschafts\u00adraum (EW<\/a>R) umfasst die Mitgliedstaaten der Europ\u00e4ischen Union (EU) sowie das F\u00fcrstentum Liechtenstein, Island und Norwegen.<\/p>\n<p>Die Datenschutz-Grund\u00adverordnung (DSGVO) bezeichnet die Bearbeitung von Personendaten als Verarbeitung personenbezogener Daten und die Bearbeitung von besonders sch\u00fctzenswerten Personendaten als Verarbeitung besonderer Kategorien personenbezogener Daten (Art. 9 DSGVO). <\/p>\n<h3 id=\"rechtsgrundlagen\">2.2 Rechtsgrundlagen<\/h3>\n<p>Wir bearbeiten Personendaten im Einklang mit dem <a href=\"https:\/\/www.fedlex.admin.ch\/eli\/oc\/2022\/491\/de\" rel=\"nofollow noopener noreferrer\" target=\"_blank\" id=\"96797\">schweizerischen Datenschutzrecht<\/a> wie insbesondere dem Bundesgesetz \u00fcber den Datenschutz (Datenschutzgesetz, DSG) und der <a href=\"https:\/\/www.fedlex.admin.ch\/eli\/oc\/2022\/568\/de\" rel=\"nofollow noopener\" target=\"_blank\">Verordnung \u00fcber den Datenschutz<\/a> (Datenschutzverordnung, DSV).<\/p>\n<p><span id=\"rechtsgrundlagen-dsgvo\">Wir bearbeiten \u2013 sofern und soweit die Datenschutz-Grundverordnung (DSGVO) anwendbar ist \u2013 Personendaten gem\u00e4ss mindestens einer der folgenden Rechtsgrundlagen:<\/span><\/p>\n<ul>\n<li><a href=\"https:\/\/steigerlegal.ch\/dsgvo\/dsgvo-6\/\" target=\"_blank\" rel=\"noopener\">Art. 6 Abs. 1 lit. b DSGVO   <\/a> f\u00fcr die erforderliche Bearbeitung von Personendaten zur Erf\u00fcllung eines Vertrages mit der betroffenen Person sowie zur Durchf\u00fchrung vorvertraglicher Massnahmen.<\/li>\n<li>Art. 6 Abs. 1 lit. f DSGVO f\u00fcr die erforderliche Bearbeitung von Personendaten, um die berechtigten Interessen von uns oder von Dritten zu wahren, sofern nicht die Grundfreiheiten und Grundrechte sowie Interessen der betroffenen Person \u00fcberwiegen. Berechtigte Interessen sind insbesondere unser Interesse, unsere Aktivit\u00e4ten und T\u00e4tigkeiten dauerhaft, nutzerfreundlich, sicher und zuverl\u00e4ssig aus\u00fcben sowie dar\u00fcber kommunizieren zu k\u00f6nnen, die Gew\u00e4hrleistung der Informationssicherheit, der Schutz vor Missbrauch, die Durchsetzung von eigenen rechtlichen Anspr\u00fcchen und die Einhaltung von schweizerischem Recht.   <\/li>\n<li>Art. 6 Abs. 1 lit. c DSGVO f\u00fcr die erforderliche Bearbeitung von Personendaten zur Erf\u00fcllung einer rechtlichen Verpflichtung, der wir gem\u00e4ss allenfalls anwendbarem Recht von Mitgliedstaaten im Europ\u00e4ischen Wirtschaftsraum (EWR) unterliegen.  <\/li>\n<li>Art. 6 Abs. 1 lit. e DSGVO f\u00fcr die erforderliche Bearbeitung von Personendaten zur Wahrnehmung einer Aufgabe, die im \u00f6ffentlichen Interesse liegt.  <\/li>\n<li>Art. 6 Abs. 1 lit. a DSGVO f\u00fcr die Bearbeitung von Personendaten mit Einwilligung der betroffenen Person.  <\/li>\n<li>Art. 6 Abs. 1 lit. d DSGVO f\u00fcr die erforderliche Bearbeitung von Personendaten, um lebenswichtige Interessen der betroffenen Person oder einer anderen nat\u00fcrlichen Person zu sch\u00fctzen.<\/li>\n<\/ul>\n<h2 id=\"art-umfang-zweck\">3. Art, Umfang und Zweck<\/h2>\n<p>Wir bearbeiten jene Personendaten, die erforderlich sind, um unsere Aktivit\u00e4ten und T\u00e4tigkeiten dauerhaft, nutzerfreundlich, sicher und zuverl\u00e4ssig aus\u00fcben zu k\u00f6nnen. Solche Personendaten k\u00f6nnen insbesondere in die Kategorien von Bestandes- und Kontaktdaten, Browser- und Ger\u00e4tedaten, Inhaltsdaten, Meta- bzw. Randdaten und Nutzungsdaten, Standortdaten, Verkaufsdaten sowie Vertrags- und Zahlungsdaten fallen. <\/p>\n<p>Wir bearbeiten Personendaten w\u00e4hrend jener Dauer, die f\u00fcr den jeweiligen Zweck bzw. die jeweiligen Zwecke oder gesetzlich erforderlich ist. Personendaten, deren Bearbeitung nicht mehr erforderlich ist, werden anonymisiert oder gel\u00f6scht. <\/p>\n<p>Wir k\u00f6nnen Personendaten durch Dritte bearbeiten lassen. Wir k\u00f6nnen Personendaten gemeinsam mit Dritten bearbeiten oder an Dritte \u00fcbermitteln. Bei solchen Dritten handelt es sich insbesondere um spezialisierte Anbieter, deren Leistungen wir in Anspruch nehmen. Wir gew\u00e4hrleisten auch bei solchen Dritten den Datenschutz.   <\/p>\n<p>Wir bearbeiten Personendaten grunds\u00e4tzlich nur mit Einwilligung der betroffenen Personen. Sofern und soweit die Bearbeitung aus anderen rechtlichen Gr\u00fcnden zul\u00e4ssig ist, k\u00f6nnen wir darauf verzichten, eine Einwilligung einzuholen. Wir k\u00f6nnen Personendaten beispielsweise ohne Einwilligung bearbeiten, um einen Vertrag zu erf\u00fcllen, um rechtlichen Verpflichtungen nachzukommen oder um \u00fcberwiegende Interessen zu wahren. <\/p>\n<p>Wir bearbeiten ausserdem Personendaten, die wir von Dritten erhalten, aus \u00f6ffentlich zug\u00e4nglichen Quellen beschaffen oder bei der Aus\u00fcbung unserer Aktivit\u00e4ten und T\u00e4tigkeiten erheben,  <\/p>\n<p>sofern und soweit eine solche Bearbeitung aus rechtlichen Gr\u00fcnden zul\u00e4ssig ist.<\/p>\n<h2 id=\"ausland\">4. Personal data abroad<\/h2>\n<p>We process personal data in Switzerland and in the European Economic Area (EEA). However, we may also export or transfer personal data to other countries, in particular to process it or have it processed there. <\/p>\n<p>We may export personal data to all <a href=\"https:\/\/de.wikipedia.org\/wiki\/Liste_der_Staaten_der_Erde#Tabelle\" target=\"_blank\" rel=\"noopener\">states and territories on Earth<\/a> as well as elsewhere in the <a href=\"https:\/\/www.datenschutzpartner.ch\/2022\/04\/23\/datenschutzerklaerung-daten-export-universum-mond\/\" target=\"_blank\" rel=\"noopener\">universe<\/a>, provided that the law there ensures adequate data protection in accordance with the <a href=\"https:\/\/steigerlegal.ch\/2022\/09\/10\/ndsg-schweiz-staatenliste\/\" target=\"_blank\" rel=\"noopener\">decision of the Swiss Federal Council<\/a> and - if and to the extent that the General Data Protection Regulation (GDPR) is applicable - in accordance with the <a href=\"https:\/\/commission.europa.eu\/law\/law-topic\/data-protection\/international-dimension-data-protection\/adequacy-decisions_de\" target=\"_blank\" rel=\"noopener\">decision of the European Commission<\/a>.<\/p>\n<p>We may transfer personal data to countries whose laws do not ensure adequate data protection, provided that data protection is ensured for other reasons, in particular on the basis of standard data protection clauses or with other appropriate safeguards. By way of exception, we may export personal data to countries without adequate or appropriate data protection if the specific requirements under data protection law are met, for example the express consent of the data subjects or a direct connection with the conclusion or performance of a contract. We will be happy to provide data subjects with information about any guarantees or a copy of any guarantees upon request.  <\/p>\n<h2 id=\"rechte\">5. Rights of data subjects<\/h2>\n<h3 id=\"ansprueche\">5.1 Claims under data protection law<\/h3>\n<p>We grant data subjects all rights in accordance with applicable data protection law. In particular, data subjects have the following rights: <\/p>\n<ul>\n<li><strong>Information<\/strong>: Data subjects may request information as to whether we process personal data about them and, if so, what personal data is involved. Data subjects also receive the information required to assert their data protection rights and to ensure transparency. This includes the personal data processed as such, but also, among other things, information on the purpose of processing, the duration of storage, any disclosure or export of data to other countries and the origin of the personal data.  <\/li>\n<li><strong>Correction and restriction<\/strong>: Data subjects can have incorrect personal data corrected, incomplete data completed and the processing of their data restricted.<\/li>\n<li><strong>Deletion and objection<\/strong>: Data subjects can have personal data deleted (\"right to be forgotten\") and object to the processing of their data with effect for the future.<\/li>\n<li><strong>Data release and data transfer<\/strong>: Data subjects may request the surrender of personal data or the transfer of their data to another data controller.<\/li>\n<\/ul>\n<p>We may suspend, restrict or refuse the exercise of data subjects' rights to the extent permitted by law. We can inform data subjects of any requirements that must be met in order to exercise their rights under data protection law. For example, we may refuse to provide information in whole or in part with reference to business secrets or the protection of other persons. We may also, for example, refuse to delete personal data in whole or in part with reference to statutory retention obligations.   <\/p>\n<p>We may exceptionally provide for costs for the exercise of rights. We will inform data subjects in advance of any costs. <\/p>\n<p>We are obliged to take appropriate measures to identify data subjects who request information or assert other rights. Data subjects are obliged to cooperate. <\/p>\n<h3 id=\"beschwerderecht\">5.2 Right to complain<\/h3>\n<p>Data subjects have the right to enforce their data protection claims through legal channels or to lodge a complaint with a competent data protection supervisory authority.<\/p>\n<p>The data protection supervisory authority for private data controllers and federal bodies in Switzerland is the <a href=\"https:\/\/www.edoeb.admin.ch\/edoeb\/de\/home.html\" target=\"_blank\" rel=\"noopener\">Federal Data Protection and Information Commissioner<\/a> (FDPIC).<\/p>\n<p>Data subjects have - if and to the extent that the General Data Protection Regulation (GDPR) is applicable - the right to lodge a complaint with a competent <a href=\"https:\/\/edpb.europa.eu\/about-edpb\/about-edpb\/members_de\" target=\"_blank\" rel=\"noopener\">European data protection supervisory authority<\/a>.<\/p>\n<h2 id=\"sicherheit\">6. Data security<\/h2>\n<p>We take suitable technical and organizational measures to ensure data security appropriate to the respective risk. However, we cannot guarantee absolute data security. <\/p>\n<p>Access to our website is via transport encryption (SSL \/ TLS, in particular with the Hypertext Transfer Protocol Secure, abbreviated HTTPS). Most browsers mark transport encryption with a padlock in the address bar. <\/p>\n<p>Our digital communication is subject - as is basically all digital communication - to mass surveillance without cause or suspicion and other monitoring by security authorities in Switzerland, the rest of Europe, the United States of America (USA) and other countries. We cannot directly influence the corresponding processing of personal data by secret services, police agencies and other security authorities. <\/p>\n<h2 id=\"website\">7. Website use<\/h2>\n<h3 id=\"cookies\">7.1 Cookies<\/h3>\n<p>We may use cookies. Cookies - our own cookies (first-party cookies) as well as cookies from third parties whose services we use (third-party cookies) - are data that are stored in the browser. Such stored data need not be limited to traditional cookies in text form.  <\/p>\n<p>Cookies can be stored in the browser temporarily as \"session cookies\" or for a certain period of time as so-called permanent cookies. \"Session cookies\" are automatically deleted when the browser is closed. Permanent cookies have a specific storage period. In particular, cookies enable us to recognize a browser the next time it visits our website and thus, for example, to measure the reach of our website. However, permanent cookies can also be used for online marketing, for example.    <\/p>\n<p>Cookies can be completely or partially deactivated and deleted at any time in the browser settings. Without cookies, our website may no longer be fully available. We actively request - at least if and to the extent necessary - the express consent to the use of cookies.  <\/p>\n<h3 id=\"logdateien\">7.2 Server log files<\/h3>\n<p>We may collect the following information for each access to our website, provided that this information is transmitted by your browser to our server infrastructure or can be determined by our web server: Date and time including time zone, Internet Protocol (IP) address, access status (HTTP status code), operating system including user interface and version, browser including language and version, individual sub-page of our website accessed including amount of data transferred, website last accessed in the same browser window (referer or referrer).<\/p>\n<p>We store such information, which may also constitute personal data, in server log files. The information is necessary to provide our website permanently, user-friendly and reliable and to ensure data security and thus in particular the protection of personal data - also by third parties or with the help of third parties. <\/p>\n<h3 id=\"zaehlpixel\">7.3 Tracking pixel<\/h3>\n<p>We may use tracking pixels on our website. Tracking pixels are also known as web beacons. Tracking pixels - also from third parties whose services we use - are small, usually invisible images that are automatically retrieved when you visit our website. These provisions inform in particular about the rights of data subjects directly vis-\u00e0-vis the respective platform, which includes, for example, the right to information. <\/p>\n<h2 id=\"dienste\">9. Third party services<\/h2>\n<p>We use services of specialized third parties to perform our activities and operations in a durable, user-friendly, secure and reliable manner. With such services, we can, among other things, embed functions and content in our website. In the case of such embedding, the services used record the Internet Protocol (IP) addresses of the users at least temporarily for technically compelling reasons.  <\/p>\n<p>For necessary security-related, statistical and technical purposes, third parties whose services we use may process data in connection with our activities and operations in aggregated, anonymized or pseudonymized form. We can use them, for example, to hold virtual meetings or conduct online lessons and webinars.
